This article explains how to request access to documents, information, etc. that you have applied for.

Documents filed and other information are available for inspection.

The JPO accepts online inspection of documents and other information.

<Request for inspection of matters recorded in the file>
This is a procedure that allows you to inspect documents that were exchanged with the JPO during the period between the filing of the trademark application and the registration decision.
For example, if a third party provides information in response to your trademark application in order to prevent the registration of your trademark, you can request access to the information provided.

<Request to inspect registered matters>
This is a procedure to inspect the registry (information on rights after registration).
Any changes in rights are also registered in the registry. Therefore, if you want to check the current status of a certain right, you need to check the registry.

How to request online

You will complete the online request procedure for the documents you wish to inspect.
After that, when the documents are prepared for inspection, they are stored on the JPO server.
Requests are then made to the JPO using the Internet application software and received online.

An overview of the online request process is described below.

(1) Prepare the request documents in HTML format
Using commercially available word processing software, create a request document in HTML format according to the format provided in the “Regulations for the Implementation of the Law on Special Exceptions to the Procedures for Industrial Property”.
A model of the e-filing request form is available at the e-Application Software Support Site.

(2) Conversion to JPO format
The request document in HTML format is checked for formatting by the Internet application software, and if there are no errors, it is converted into the format specified by the JPO. If there are any errors, the request documents are corrected.

(3) Submit a transmittal file converted to JPO format.

Period during which viewing is available

The time when the documents can be viewed from the online request differs depending on the type of documents to be viewed.

(1) Matters on file, Trademark Registry Registry pertaining to trademark rights based on international registration (Madopro)
Documents requested online between 9:00 a.m. and 8:00 p.m. on the day the office opens.
→Documents can be inspected at any time within about 1 hour after the online request is made.

Documents requested online after 8:00 p.m. of the opening day
→Documents requested online after 20:00 of the opening day can be inspected from 10:00 of the following day of the opening day.

(2) Patent Registry and Registration Registry (excluding Madopro Registry)
→Documents requested online between 9:00 a.m. and 7:00 p.m. can be inspected anytime within 2 to 4 hours after the online request.

Documents requested online after 19:00 daily office opening
→Documents requested online after 19:00 JST can be inspected from 11:00 JST of the following day of the opening of the office.

Documents are available for inspection for 5 days from the day after the day they become available for inspection.
Receive the documents within this period.
