What documents do I need to prepare when I file a trademark application?

Basically, all you need to do is submit an “Request for trademark registration” (商標登録願) to the Japan Patent Office.

This article describes the documents required for filing a trademark application.

Documents required for filing a trademark application

When filing a trademark application, basically all you need to do is submit a “Request for trademark registration” (商標登録願) to the Commissioner of the Patent Office.
Other than the “Request for trademark registration”, there are basically no other documents required when filing an application.
In Japan, it is also not necessary to submit a power of attorney when filing an application.

Preparation of “Request for trademark registration”

A model for “Request for trademark registration” is available on the Intellectual Property Consultation Support and Portal Site.
First, download the model from the above site.

Example of filling out “Request for trademark registration”

Once you have downloaded “Request for trademark registration” Form template, please fill in the bibliographic information for “Request for trademark registration” form.

Below is a brief example of how to fill out the form.

【整理番号】
Enter a reference number to distinguish it from other applications filed by the applicant, using Roman letters (capital letters only), Arabic numerals, “-“, or a combination of these, not exceeding 10 characters.

【提出日】
If you are submitting the application in person at the JPO, enter the date of submission; if you are submitting the application by mail, enter the date when you drop it off at the post office.

【商標登録を受けようとする商標】
In this field, the trademark (letters, graphics, etc.) for which the applicant is seeking trademark registration should be written directly in the trademark description field (square) of 8 cm square in size.

In accordance with the type of trademark for which the application is being filed, the “○○” column should be placed between the 【商標登録を受けようとする商標】 and the 【指定商品又は指定役務並びに商品及び役務の区分】, and the “Standard character”, “3D trademark”, “motion trademark”, “hologram trademark”, “trademark consisting only of colors”, “sound trademark” or “position trademark” should be placed in this column.
If the applicant wishes to register a trademark for ordinary letters or figures, the [○○] field should not be filled in.

*When a trademark is registered using only the characters designated by the Commissioner of the Patent Office (standard characters):
the trademark description field must be written horizontally on a single line (no more than 30 characters) in full-width, black letters of the same size and typeface (10 points or larger).

【指定商品又は指定役務並びに商品及び役務の区分】

In the “Class ○” column, the classification from 1 to 45 as provided for in the appended table in Article 2 of the Trademark Law Enforcement Order shall be indicated in parentheses.
In the “Designated goods (designated services)” column, the content and scope of the goods (services) shall be indicated in a manner that is clearly understandable.

If If you do not know how to write the classes of goods/services or designated goods/services, please use the “Product/Service Name Search” on the Patent Information Platform (J-PlatPat) [Trademark].

【商標登録出願人】

In the [Identification Number] column, enter the identification number only if you have been notified of it by the JPO.
If you are filing an application for the first time, the [Identification Number] field is not required.

【氏名又は名称】

If the applicant for trademark registration is a natural person (individual), enter his/her name.
If the applicant for trademark registration is a juridical person, enter the name of the juridical person (name (trade name) registered at the competent registry), and enter only the name of the representative in the [Representative] column following the [Name or Designation] column (titles such as position are unnecessary. For individuals, the [Representative] column is not required.

（commission）
The application fee is paid by patent revenue stamps in the amount equivalent to the fee. Purchase the stamps at any post office in Japan and affix them to the upper left margin of the application for trademark registration.

It seems hard to prepare the application form while reading the writing guide….
Also, it seems difficult because of the detailed regulations on how to describe “applicant for trademark registration” and “name”.

Disadvantages of preparing “Request for trademark registration” in person

You can prepare your own “Request for trademark registration” documents. However, some familiarity is required to prepare “Request for trademark registration” yourself. If you submit an incomplete “Request for trademark registration” in person to the Patent Office, you run the following risks.

-“Request for trademark registration” in person with incomplete statements will not be accepted or examined by the Commissioner of the Patent Office. In such cases, additional documents (hereinafter referred to as “written supplement”) must be submitted within the designated time period, which requires additional time to complete the paperwork.
-Failure to submit written supplement to the JPO will result in the rejection of the application by the Commissioner of the JPO.
-Even if the applicant submits written supplement to the JPO and the deficiencies are resolved, the date of submission of written supplement is recognized as the filing date of the application. This delays the filing date by many days.
