Here are some books on trademarks to help you in your quest for trademark registration!

I’ve decided to apply for a trademark for my company! But I don’t know much about trademarks, so I want to learn from a book!
There are several books that should be read by anyone seeking to register a trademark. I will introduce them to you.

This article introduces books and other publications and their titles for those involved in work related to trademark registration.

Books on Trademark Law

If you are involved in intellectual property work, not just trademarks, there is a book you should own. Here it is.

・Intellectual Property Laws and Regulations “知的財産権法⽂集”(Editing and publishing General Incorporated Association Association for the Advancement of Invention )

This is a collection of laws and regulations that contains general laws related to intellectual property rights. The full text of the Trademark Law can be found in this law book.
As laws are revised, new revised editions are published. Use the latest edition of the law book.

・Article-by-Article Explanation of the Industrial Property Law ”⼯業所有権法(産業財産権法)逐条解説”(editing 特許庁総務部総務課制度審議室、publishing General Incorporated Association Association for the Advancement of Invention)

This book explains the legislative intent of each article of the Intellectual Property Law. By confirming the legislative intent, you can deepen your understanding of the articles.
The latest version of the article-by-article commentary can be downloaded from the JPO website.

The two books mentioned above are indispensable for anyone involved in intellectual property and especially for those who want to become patent attorneys.

Books on procedures from application to registration.

・Books that explain procedural-related details

Several books explaining the process from application to registration of a trademark have been published and are available at bookstores. It is advisable to choose the book that best suits your practical situation and the information you wish to obtain.
Information on the basic flow and procedures from application to registration can also be found on the JPO website.

・Trademark Examination Standards ”商標審査基準” (editing Patent Office publishing General Incorporated Association Association for the Advancement of Invention)

Detailed explanations are provided on how trademark applications are examined and the examination criteria.
It is published as a book, but can also be downloaded from the JPO website.

The firm’s Amazing DX website also provides detailed information on trademark matters. The website explains not only the procedures, but also the scope of trademark rights, the subject matter of protection, renewal after registration, and other trademark-related matters in general. For more comprehensive information, please visit the Amazing DX website.

So many books on trademarks abound these days!
But depending on the content, it can be difficult to learn from practical books alone.

Some content is difficult to learn from books alone

It would be good if we could carry out our work only with information obtained from books, websites, and other sources. However, in actual practice, there are cases that you may have trouble dealing with even if you look up books by yourself.
For example, many people are concerned about which goods or services (services) to choose when filing an application.

Those who are familiar with trademark law and have handled many applications and responded to multiple notices of reasons for refusal, such as the staff members working in patent firms, are familiar with how to choose the designated goods and services.
There is no one-size-fits-all method for selecting designated goods and services, and the method will vary depending on the case and the nature of the business. Therefore, it is difficult to learn how to select designated goods and services only from practice books.

The same is true for foreign filings. Practices in various countries are constantly changing, and the practical knowledge of local representatives is essential for foreign matters. For this reason, there are many cases that cannot be handled only by information obtained from in-house practice books or websites, and require consultation with experts.

Even if you get some knowledge from books, it doesn’t mean that you can actually do all of the work. Trademark-related work is not easy, after all.
Although many useful books have been published recently, they do not contain enough complete information to carry out the work. It can take an inordinate amount of time just to research the questions you have. In such cases, it is a good idea to consult an expert.
I’d feel a lot better knowing you’re talking to a professional with practical experience!

If you have a problem that can’t be solved by the book, contact our office!

In practice, you will find many things that cannot be solved by reading books. If you have any concerns, don’t keep them to yourself, contact our firm for any help you may need!
