How much does trademark registration cost over 10 years?

What are the costs after trademark registration?

I understand that there are fees at the time of application and registration, but after registration, are there maintenance fees?

Renewal of trademark right is every 10 years, so once the registration fee (for 10 years) is paid to the JPO, there is basically no maintenance fee until the renewal procedure after 10 years.

I see. I’d like to know more about it.

Key points

Trademark renewal is every 10 years.

Fees for trademark registration can be divided into two categories: fees at the time of application and fees at the time of registration. (For details, please refer to the following page)

Regarding the fees required after registration, the system differs from that of patents and designs. Trademarks are not subject to annual registration fees, but if a registration fee (for 10 years) is paid to the JPO at the time of trademark registration, the trademark right basically lasts for 10 years and no maintenance fee is required until the time of renewal procedures after 10 years.
When renewing a trademark right, if a renewal registration fee (for 10 years) is paid to the JPO, there is basically no maintenance fee until the next renewal procedure after 10 years.
Therefore, considering that the duration of the right is 10 years (renewal is possible), it may be considered inexpensive.

On the other hand, it is possible to pay the trademark registration fee and renewal registration fee in two installments of 5 years each if desired. However, in the case of payment in installments, Official fee is set at a higher rate, and basically, Attorney’s fee will also be charged according to the number of times the payment is made. (See examples of fees below).
Therefore, if you plan to use your trademark for a long period of time, it is recommended that you pay for 10 years.
On the other hand, if you do not know whether you will use the trademark for a long period of time (more than 5 years), you may pay the first 5 years’ fees at the time of trademark registration and consider whether to pay the second 5 years’ fees after 5 years, before the deadline for payment of the second 5 years’ fees.

[Reference] Basically, the term of a trademark right is 10 years (renewal is allowed), but if the second five-year term is not paid in installments, the trademark right is deemed to have expired five years prior to the expiration of the term (Article 41-2(6) of the Trademark Law).

[Reference] In principle, an application for renewal of a trademark right must be filed between six months prior to the expiration of the duration of the trademark right and the date of expiration (Article 20(2) of the Trademark Law). If the application for renewal cannot be filed within this period, it is still possible to file a renewal application within six months after the expiration of the term, but in this case, in addition to the regular registration fee, a surcharge of the same amount as the registration fee must be paid (Articles 20(3) and 43(1) of the Trademark Law).
